Rental Agreement

Dear Villa Blue Guest, 

We can't wait to host your upcoming stay! We understand that reading through the rental agreement is not the most exciting part of the process. Please take a moment to review both the rental agreement and the golf cart agreement. It's essential to fully understand the terms and conditions outlined. If you have an outstanding balance and wish to make a payment, please email us. Alternatively, the card on file will be charged 30 days prior to your arrival. Upon check-in, we kindly request a photo ID from the individual listed on the reservation. You may email or send this via text message prior to your stay or upload in your guest portal. 

THE PARTIES. This Short-Term Rental Agreement (“Agreement”) made on the reservation date for Villa Blue between the Primary Guest, and

Host: Villa Blue LLC  (“Host”).

 

THE PREMISES. The Host agrees to rent the described property below to the Guest, and the Guest agrees to rent from the Host:

Hereinafter known as the “Premises.”

 

RENTAL TERM. The Guest shall be allowed to occupy the Premises starting {{checkin_date}} from {{checkin_time}} and ending {{checkout_date}} at {{checkout_time}} (“Rental Term”).

QUIET HOURS. Quiet hours begin at 10:00 PM each night and continue until sunrise. Quiet hours consist of no music and keeping all audio at a minimum level out of respect for the surrounding residents.

OCCUPANTS. The total number of individuals staying on the Premises during the Rental Term shall be a maximum number of (12) guests in bed. The Guest agrees not to exceed the occupancy. Babies under the age of 1 are not included in the occupancy count. Host does not rent to ANYONE UNDER THE AGE OF 25. Violation will result in immediate termination of the Rental Agreement with no refund for any remaining nights. 

If more than the authorized number of guests listed above are found on the Premises, this Agreement will be subject to termination by the Host.

BOOKING FEES. The Guest shall pay the Host the amount as detailed during the booking process.

PAYMENT. A deposit of 50% of the Rental Amount is due at the time the reservation is made. The remaining balance is due 30 days prior to arrival and will be automatically charged to the credit card on file unless the Guest makes prior arrangements for an alternative method of payment. Reservations made 30 days or less prior to arrival require payment in full at time of booking for final confirmation. Payment cannot be made by cashier’s check or money order. If using a check for payment, please make out to: Piper Horton and note Villa Blue in the memo. If a check is returned unpaid for any reason, a $14 fee will be added to the invoice.

Host will notify the Guest via email or phone call, advising of the returned check. An alternate payment method must be used, and payment must be received in 3 days from when the Guest is notified. If a Guest is mailing in check for payment, Host is not responsible if payment is lost/stolen in mail.

Credit card information must also be provided. If paying the remaining balance with a credit card, there will be a 4% service charge that will be added to your booking total. If credit/debit card is declined, an alternate payment method will need to be used. A payment must be received in 3 days from the declined payment. Once the Guest’s deposit payment is processed, the Guest will receive a confirmation statement and Rental Agreement via email.

The Rental Agreement must be signed and returned to Host before Host will confirm the Guest’s reservation. Advertised or quoted rental rates are subject to change without notice. Host reserves the right to correct advertised or quoted rental rates that may have been misquoted due to human and/or computer error. The Rental Amount identified in this Agreement shall control.

While there may be numerous occupants of the Property during the Rental Period, only the Guest(s) signing this Agreement will be held responsible by Host for payment of the Rental Amount, the Security Deposit, any additional fees, and all other renter responsibilities enumerated in this Agreement. The grill must be cleaned by the Guest prior to departure. 

SECURITY DEPOSIT. The Guest shall be obligated to pay the following amounts upon the execution of this Agreement: $500

Security Deposit amount as detailed in the booking process. The Security Deposit is for the faithful performance of the Guest under the terms and conditions of this Agreement. The Guest must pay the Security Deposit at the execution of this Agreement. The Security Deposit shall be returned to the Guest within the State's requirements after the end of the Rental Term less any itemized deductions. This Security Deposit shall not be credited towards any Rent unless the Guest gives their written consent. The deposit will be charged, if any of the following are met: 

  1. Damage done to the golf cart, home or its contents, beyond normal wear and tear.

  2. Charges incurred due to contraband, pets, fines, or collection of rents or services rendered during the stay. 

  3. Debris, trash, and discards not placed in designated trash area. 

  4. Keys not returned.

  5. Linens or towels lost or stolen.

  6. Additional charges imposed by the cleaning company.

  7. Renter evicted by Host or local law enforcement.

GUEST INSPECTION. Upon check-in, the Primary Guest is responsible for inspecting the property and reporting any maintenance issues or necessary repairs to the Host within 2 hours. 

AMENITIES. During your stay, promptly report any maintenance problems to Host by phone at 970.379.8921 or email at villabluepa@gmail.com. No refund or rate adjustment will be made for unforeseen failures including, but not limited to, the supply of electricity, water, pool filtration systems, air conditioning, telephone, television, cable, internet services, appliances, or golf carts.

AIR CONDITIONING REGULATIONS. Please be kind when changing the temperatures of the A/C units. It will run at an optimal level if run NO LOWER than 72 degrees. If lowered past that temperature, there is a risk of freezing the motor and causing the whole system to malfunction. If A/C is frozen and services need to be called, the service cost will be billed back to the Primary Guest. 

GOLF CART. The home comes with a complimentary use of a golf cart. Owner or Host does not guarantee the golf cart will be available the entire length of your stay as a result of things outside of our control (i.e. maintenance, destruction, unsafe conditions, etc.). Refunds will not be made for maintenance issues. Primary Guest acknowledge that the golf cart was in good condition, with no visible damage, at the time of check-in and assumes full responsibility and liability for care of the golf cart and and/all damages incurred. Any damage identified prior to taking possession of the golf cart should be immediately reported to the Host prior to use to avoid Primary Guest assuming liability for any previous existing damage. Refer to Exhibit A for agreement

CHECK-IN and CHECK-OUT. CHECK-IN TIME IS AT 4:00 P.M. Plan to arrive no earlier than 4:00 P.M. Do not use the Property before check-in. We will make every effort to ensure that the Property is available for check-in at 4:00 P.M., but cannot guarantee it. If the Property is available and ready for rental prior to 4:00 P.M., an early check-in will be allowed. Host will only give KEY CODE to the Guest who signed the Agreement, unless prior arrangements have been made. Host rents to responsible individuals 25 years or older. A VALID STATE DRIVER’S LICENSE OR OTHER ACCEPTABLE PHOTO IDENTIFICATION IS REQUIRED PRIOR TO CHECK-IN. Host reserves the right to refuse service. CHECK-OUT TIME IS BY 11:00 A.M. Guest agrees that once they have checked in to the Property, no refund will be made for early check-outs. If Guest does not cancel the reservation and does not arrive for the Guest's Rental Period, all money paid will be forfeited. The Guest agrees to surrender the Property and associated amenities in the same condition as at commencement of the Rental Period. In cases of abuse, malicious, excessive, and/or intentional damage to the Property (as determined in Host’s sole discretion) in excess of $50, Guest will reimburse Host the full amount of any and all damages, including additional housekeeping expenses and reasonable attorney's fees.

CHECK-OUT PROCEDURES. 

  1. Remove all trash and place in designated trash bins outside. All trash must be bagged and tied. 

  2. All beach items must be hung or stored. Additional charge if blow up rafts or toys are left behind. 

  3. Place all dirty dishes in dishwasher and start the cycle

  4. Bed linens and towels to be left as-is

  5. Clean the grill and cover it

  6. Clean the golf cart and store in garage, providing pictures to HOST and leaving key on hook by front door. 

  7. Lock all doors and windows. 

PETS. A maximum of one trained pets is allowed on the property. A $50 non-refundable per pet fee is required at time of booking. Additional deposits may be required. The Guest will be financially responsible for any damages and extra cleaning due to pets, which may be charged to the Guest’s credit card on file. Guests must pick up their pet's excrement on or surrounding the property. Having a pet on the property that is non-disclosed are grounds for immediate eviction and termination of this Agreement without refund at Host option and will incur a $500 cleaning charge. Pets are not allowed in pool areas and dogs must be kept on a leash outdoors. Please ensure Pet does not bother other guests in the complex with excessive noise, barking, etc. Pets must be bathed to prevent fleas and be current on all vaccinations. Proof of these vaccinations is required upon contract execution. Rabies vaccination is required by the State of Texas. 

SMOKING POLICY. Smoking and/or vaping and use of illegal drugs is not permitted inside or outside of Host rental property. Guests will be financially responsible for any damages and extra cleaning due to smoking in a Non-Smoking designated property. If evidence of smoking/vaping exists, the Guest credit card on file will be charged an additional $500 cleaning fee. An additional $100 grounds cleaning fee will be charged for cigarette debris left by Guest and/or Guest’s invitees outside the Property.

SPRING BREAK (PARENT CHAPERONED GROUPS). One parent/chaperone above the age of 25 must be present for every 4 guests under the age of 21. Parent chaperones must be present at the HOME during the entire reservation. For reservations in March and April, proof of age is required by all parent/chaperones. The Home is subject to inspection during the reservation to ensure compliance. Violations will result in immediate eviction and forfeiture of rent and security deposit as well as any damages and costs incurred by the Host. 

FALSE PRETENSES. Making a reservation under false pretenses is subject to immediate eviction and forfeiture of rent plus damage deposit, and potentially additional charges for damages and costs incurred. 

FIREARM POLICY. No firearms allowed on site.

FIRE POLICY. No fireworks on site. All candles cannot be left unsupervised. Please contact 911 in case of emergency. 

CLEANING. A $25 fee will be charged to the credit card on file for charcoal and food removal or grate cleaning. A $25 fee will be charged to the credit card on file for excessive trash. Excessive trash is anything that has to be hauled away because it will not fit in the provided receptacles.

CANCELLATION POLICY. 

VRBO/Homeaway/Direct Booking - Cancellations that are requested more than 30 days prior to the arrival date will receive a full refund, less credit card fees of approximately 4%. 

Airbnb - 100% of the base rental amount will be refunded if the cancellation is made more than 31 days prior to the arrival date of the reservation. Any cancellation 30 days or less prior to arrival date will result in the forfeit of 100% of the Rental Amount. 

Reschedule - Guests may amend their travel dates up to 30 days prior to their reservation dates. Amendments are not allowed within 30 days of the reservation date.

Cancellations are effective on the date written notice is received by communication via the channel in which the Primary Guest booked or by emailing villabluepa@gmail.com. If a refund is applicable, the refund payment will be processed within two weeks of Host’s receipt of the cancellation notice and will be paid via check or by refund to the Guest’s credit card on file. 

HURRICANE EVACUATION POLICY. Host will not issue any refunds for delays or cancellations due to hurricane evacuations or any other natural disasters. Host encourages you to purchase travel insurance (including hurricane travel insurance) with coverage for mandatory hurricane evacuations and all other natural disasters (subject to policy terms and conditions) in order to protect your travel investment. You may purchase travel insurance from a provider of your choice.

SWIMMING POOL USAGE. Host is not responsible for injuries or accidental death resulting from utilizing the pool or surrounding area. Guest and any of Guest’s invitees utilize any swimming pools and surrounding areas located at the Property at their own risk, and are solely responsible for ensuring that access to and use of any swimming pools on the Property is done safely and with proper supervision, if applicable.

INDEMNIFICATION OF HOST BY GUEST. Host may offer access to recreational and water activities. Guests fully understand and acknowledge that outdoor recreational and water activities have inherent risks, dangers and hazards. Participation in such activities and/or use of equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability. Guest agrees to fully indemnify and hold harmless Host, and any and all owner(s), agents, employees, or contractors for any injury or damage caused by these activities, whether caused by the negligence of Host or the Owner(s), the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes foreseeable or unforeseeable. Guests hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of Host or the Owner(s) or by any other person. Guest hereby voluntarily agrees to release, waive, discharge, hold harmless, defend and indemnify Host and any owner(s), all agents, employees, or contractors from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of use of the Rental Property (Villa Blue LLC) facilities, equipment, or activities. Guest further assumes full responsibility for the actions of any and all persons whom he/she may allow to enter the property during the rental period and indemnifies Host and Owner(s) from any and all claims arising from such other persons. This indemnity shall survive termination of this Agreement.

SUBLETTING. The guest does not have the right to sublet the Premises. 

PROPERTY AVAILABILITY. In the event that the dwelling is undergoing any major repairs during the Rental Period, Host shall be held harmless by Guest. Rental rates are subject to change based on comparable accommodations. If comparable accommodations, based on Host’s recommendations, are not available, the Guest agrees to accept a full refund of any monies paid as full and final satisfaction.

PROPERTY CONDITION. Villa Blue LLC will not be held liable for any injuries, accidents, theft, damages, or other misfortune or harm that may befall the Guest and/or the Guest’s invitees during their stay at the Property. If furniture is moved, the Guest will be responsible for any charges incurred in returning it to its proper location. Host has closets and cabinets that are locked or inaccessible. These are for the Owner’s use only and will not be available for Guest’s use. Tampering with any of these will result in a forfeiture of the Security Deposit and the Guest will be responsible for the full amount of any and all damages, including additional housekeeping expenses and reasonable attorney’s fees. If the Guest tampers with or breaks into a Property Owner's area, the Guest will be charged for breaking and entering.

PERSONAL PROPERTY. Lock all doors and windows when you leave the Property. We also highly recommend locking up when enjoying the pool or beach. Host nor the Property Owner(s) will be held liable for any lost or stolen items, other damages to any personal property, nor for personal items left by Guest in the Property at departure or during stay. Thoroughly check all drawers and closets before departing. Any personal items or possessions that are left on the Premises upon check-out are not the responsibility of the Host. The Host shall make every reasonable effort to return the item to the Guest for a $25 fee plus shipping costs. If claims are not made within the State’s required time period or two (2) weeks, whichever is shorter, the Host shall be able to keep such items to sell or for personal use.

INSPECTION. The Host has the right to inspect the Premises with prior notice as in accordance with State law. Should the Guest violate any of the terms of this Agreement, the rental period shall be terminated immediately in accordance with State law. The Guest waives all rights to process if they fail to vacate the premises upon termination of the rental period. The Guest shall vacate the Premises at the expiration time and date of this agreement.

MAINTENANCE AND REPAIRS. The Guest shall maintain the Premises in a good, clean, and ready-to-rent condition and use the Premises only in a careful and lawful manner. The Guest shall leave the Premises in a ready to rent condition at the expiration of this Agreement, defined by the Host as being immediately habitable by the next Guest. The Guest shall pay for maintenance and repairs should the Premises be left in a lesser condition. The Guest agrees that the Host shall deduct costs of said services from any Security Deposit prior to a refund if Guest causes damage to the Premises or its furnishings.

Even the best or newest equipment occasionally malfunctions and cannot be guaranteed 100% of the time. Problems are corrected as soon as humanly possible. Host or an authorized employee or repairman may enter the premises during business hours for any purpose connected with the repair, care, or maintenance of the Property. Refunds will not be issued due to malfunctioning equipment or other Guest dissatisfaction with the Property or its surroundings.

TRASH. The Guests shall dispose of all waste material generated during the Rental Term under the strict instruction and direction of the Host.

QUIET ENJOYMENT. The Guest, along with neighbors, shall enjoy each other’s company in a quiet and respectful manner to each other’s enjoyment. The Guest is expected to behave in a civilized manner and shall be good neighbors with any residents of the immediate area. Creating a disturbance of the area by large gatherings or parties shall be grounds for immediate termination of this Agreement. This includes weddings, cocktail parties, receptions, welcoming events, anniversaries, and milestone birthday parties. 

ITEMS RETURNED. Please ensure all items used at the premise are kept at the premise. All beach items are free to be used, but must be returned in clean condition so Host can continue providing amenities to future guests. Beach towels to be only used at the beach. House towels must stay on the premise. 

HOST’S LIABILITY. The Guest and any of their guests hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss arising from the use of the Premises regardless of the nature of the accident, injury or loss. The Guest expressly recognizes that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of Guest and that Guest should purchase their own insurance for their guests if such coverage is desired.

ATTORNEY’S FEES. The Guest agrees to pay all reasonable costs, attorney's fees, and expenses that shall be made or incurred by the Host enforcing this agreement.

USE OF PREMISES. The Guest shall use the Premises for residential use only. The Guest is not authorized to sell products or services on the Premises or conduct any commercial activity.

ILLEGAL ACTIVITY. The Guest shall use the Premises for legal purposes only. Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behavior shall cause immediate termination of this Agreement with no refund of pre-paid Rent.

VERBAL AGREEMENTS. This Agreement may not be modified, amended, or terminated verbally. No modification, amendment, or termination, or any waiver of any of the provisions of this Agreement, shall be binding unless the same is in writing and signed by the person against whom such modification, amendment, or waiver is sought to be enforced.

GOVERNING LAW. This Agreement shall be governed and subject to the laws located in the jurisdiction of Premise’s location.

NO WAIVER. The failure of any of the Parties to enforce at any time any provision of this Agreement shall not be construed to be a waiver of such provision, nor in any affect the validity of this Agreement or any part thereof or any right of any person thereafter to enforce each and every provision. No waiver of any breach of this Agreement shall be held to constitute a waiver of any other breach.

ENTIRE AGREEMENT. This Agreement constitutes the entire Agreement between the Guest and Host concerning the rental of the Property described herein and supersedes and replaces any and all prior agreements between the Guest and Host if any, whether written or oral, concerning the rental of the Property. It is understood and agreed that all future rights and obligations of the Parties as to each other shall be governed solely by this Agreement. 

THIS IS A LEGAL DOCUMENT. READ IT CAREFULLY. IF YOU DO NOT UNDERSTAND THE EFFECT OF ANY PART OF THIS AGREEMENT, SEEK LEGAL ADVICE.

Please complete all fields. You may cancel this authorization at any time by contacting us. This authorization will remain in effect until 7 days after departure, unless otherwise noted.
